DOE found that commercial refrigerator basic model S32E-3 failed to comply with the energy conservation standards.

DOE ordered HMC Enterprises LLC to pay a $1,666 civil penalty after finding HMC had manufactured and distributed in commerce in the U.S. multiple units of commercial refrigerator basic model S32E-3.  The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and HMC.

DOE issued a Notice of Allowance to HMC on April 26, 2018, after HMC provided documentation showing that it had modified the basic model S32E-3 to comply with the applicable energy conservation standard.  HMC may distribute the new model S32E-3-200 after it has submitted the required certification report for this basic model.  Unmodified units may not be distributed in commerce in the U.S.

On November 9, 2017, DOE issued a Notice of Noncompliance Determination to HMC finding that commercial refrigerator basic model S32E-3 does not comply with applicable energy conservation standards based on DOE testing.  HMC was required to notify each person (or company) to whom HMC distributed the noncompliant products that the product does not meet Federal standards.  In addition, HMC provided DOE documents and records showing the number of units HMC distributed and to whom.
