DOE ordered Atosa Catering Equipment Inc. to pay a $16,000 civil penalty after finding Atosa had failed to certify that certain models of commercial refrigerators and freezers comply with the applicable energy conservation standards. The Order adopted a Compromise Agreement, which reflected settlement terms between DOE and Atosa.
DOE alleged in a September 28, 2018 Notice of Proposed Civil Penalty that Atosa failed to certify certain models of commercial refrigerators and freezers as compliant with the applicable energy conservation standards. DOE regulations require a manufacturer (which includes importers) to submit reports certifying that each basic model of its products have been tested and meet the applicable standards. This civil penalty notice advises the company of the potential penalties and DOE's administrative process, including the company's right to a hearing.
