PSH-13-0075 - In the Matter of Personnel Security Hearing

On September 6, 2013, a Hearing Officer determined that an individual’s security clearance should not be restored. In reaching this determination, the Hearing Officer found that the individual had not successfully addressed the DOE’s security concerns regarding foreign preference and violation of a commitment that he made to the DOE in 2010 that the agency relied on in granting him access authorization. Specifically, at that time the individual promised that he would use only his U.S. passport for foreign travel, yet in 2013 he renewed and used his foreign passport. Although the individual used his foreign passport to escort his mother on a religious pilgrimage from the country of his birth to another foreign country, the Hearing Officer found that he could have readily achieved his goal in this regard without violating his commitment to the DOE.
