On November 6, 2012, a Hearing Officer determined that an individual’s security clearance should not be restored. In reaching this determination, the Hearing Officer found that the individual had not successfully addressed the DOE’s security concerns regarding his abuse of alcohol. The Hearing Officer further concluded that the individual’s six months of responsible behavior regarding alcohol were insufficient to demonstrate a sustained pattern of responsible use. This was because of the brevity of the period of time involved, the individual’s failure to admit that he had a drinking problem, and his failure to take steps to address the problem other than abstinence. The Hearing officer also concluded that alcohol consumption that was in violation of a court order, such as that engaged in by the individual, could not constitute responsible use, regardless of the amount of alcohol consumed.
