Personnel Security Decision  (10 CFR Part 710)

On February 4, 2015, an OHA Administrative Judge (AJ) issued a decision in which she concluded that the DOE should not restore an individual’s suspended access authorization.  A DOE Operations Office referred the individual to administrative review citing as security concerns the individual’s diagnoses of Other Specified Personality Disorder and Alcohol Use Disorder, both of which are mental conditions which cause, or may cause, a significant defect in judgment and reliability, as well as information pertaining to the individual’s excessive consumption of alcohol.  After conducting a hearing, convened at the individual’s request, and evaluating all relevant evidence, the AJ concluded that, although the individual presented evidence that he was undergoing treatment for his psychological conditions and alcohol-related issues, he did not present sufficient information to adequately mitigate the cited security concerns.  Therefore, the AJ found that the DOE should not restore the individual’s suspended DOE access authorization.  OHA Case No. PSH-14-0089 (Diane DeMoura)

On February 2, 2015, an OHA Administrative Judge (AJ) issued a decision in which she concluded that the DOE should restore an individual’s access authorization.  A DOE Operations Office referred the individual to administrative review citing as security concerns the individual’s financial irresponsibility and failure to follow DOE rules and regulations.  After conducting a hearing convened at the individual’s request, and evaluating all relevant evidence, the AJ concluded that the individual had presented sufficient information to adequately mitigate the cited security concerns. On February 4, 2015, an OHA Administrative Judge (AJ) issued a decision in which she concluded that the DOE should grant an individual’s request for a DOE access authorization.  A DOE Operations Office referred the individual to administrative review citing as security concerns the individual’s failure to file her federal income tax returns for 2008, 2009 and 2012.  After conducting a hearing convened at the individual’s request, and evaluating all relevant evidence, the AJ concluded that the individual had presented sufficient information to adequately mitigate the cited security concerns.
